General and purpose

These general terms and conditions of use and sale (hereinafter the "Terms") govern the use of the Benevoo platform, accessible at www.benevoo.ch, as well as all services offered there.

Benevoo is a Swiss web platform dedicated to the management of events and volunteers. It allows event organizers to create, configure and manage their events, to recruit and coordinate their volunteers, and to offer paid or free supplementary activities to participants.

The platform is published by Innova Web Bühlmann, sole proprietorship, whose contact details are listed in the legal notice.

Definitions

In these Terms, the following terms have the meaning indicated:

  • Platform / Benevoo: the website and associated services published by Innova Web Bühlmann.
  • Organizer: any natural or legal person with a free or paid account on Benevoo to manage one or more events.
  • Volunteer: any person registering free of charge via the platform to provide assistance at an event organized by an Organizer.
  • Participant: any person registering for a supplementary activity (paid or free) offered by an Organizer as part of an event.
  • Member: any person registered in the groups of an Organizer.
  • Event: event created by an Organizer on Benevoo (festival, party, tournament, etc.).
  • Activity: supplementary service associated with an event (dinner, tournament, evening, etc.), which may be paid or free.
  • User: any person using the platform, whether as Organizer, Volunteer or Participant.

Acceptance of terms

Access to and use of the Benevoo platform implies the unreserved acceptance of these Terms. Users who do not accept the Terms must cease using the platform.

Acceptance takes place at the latest when creating an account or when registering for an event, an activity or a volunteer slot.

These Terms apply to all Users, to the exclusion of any other conditions, in particular those of Organizers for the use of the platform.

Organizer accounts and subscriptions

A free account gives access to certain Benevoo functions, within the limits indicated in the application. The other functions, including creating an event with its modules, require the Organizer to subscribe to a paid plan. The subscription plans, their content and pricing are detailed on the dedicated pricing page, which is publicly accessible.

The Organizer undertakes to provide accurate, complete and up-to-date information when creating their account. They are solely responsible for the confidentiality of their login credentials and for all actions performed from their account.

The subscription is concluded for a duration defined at the time of subscription. The billing, renewal and termination terms are specified in the subscription contract signed with the Organizer.

Benevoo reserves the right to suspend or terminate an Organizer account in case of non-payment, violation of these Terms or fraudulent use of the platform.

Volunteer registrations

A Volunteer's registration to an event is entirely free. No fees are charged to the Volunteer for registering, unregistering or modifying their slots.

The volunteer relationship is established directly between the Volunteer and the event Organizer. Benevoo acts solely as a technical platform for matching and managing.

The Volunteer undertakes to provide accurate information when registering and to respect the commitments made to the Organizer (attendance at chosen slots, compliance with instructions, etc.).

Paid activities, membership fees and payments

Organizers may offer paid supplementary activities (meals, evenings, tournaments, etc.) as part of their events. The price of each activity is freely set by the Organizer.

The Organizer chooses, when configuring their activity, whether or not to enable online payment on the platform. Two modes are possible: (a) Online payment enabled: the Participant pays their registration directly via TWINT, Mastercard or Visa (Swiss cards only); (b) Online payment not enabled: the price is displayed for information only, the Participant pays the Organizer directly according to the terms defined by the latter (on-site, bank transfer, etc.) and Benevoo is not involved in this transaction.

When online payment is enabled, payments are processed by Payrexx SA, Burgstrasse 18, 3600 Thun, Switzerland, a Swiss payment service provider certified PCI DSS Level 1. Benevoo does not store or directly process Participants' bank card data.

In case of online payment, the validation of the Participant's registration is subject to actual receipt of payment. If payment fails, the registration is not taken into account.

Prices displayed on the platform are in Swiss francs (CHF), taxes included. The VAT conditions applicable to Benevoo are specified in the legal notice.

The Organizer may also send their members membership fees or payment requests, each with a personal payment link via WhatsApp or SMS; they guarantee that the amounts requested are owed, and Benevoo may limit sending in case of abuse.

Role of Benevoo in payments

Benevoo acts as a technical collection platform. Amounts paid by Participants and Members for activities, membership fees and payment requests are collected by Innova Web Bühlmann and then paid to the relevant Organizer, after deduction of the service commission due to Benevoo.

Benevoo charges a service commission on each payment collected on behalf of an Organizer. The amount and terms of this commission are agreed in the commercial agreement concluded with the Organizer; absent such an agreement, the commission displayed on the platform applies.

Payout deadline

Collected amounts are paid to the Organizer within a maximum period of 30 days following the end of the event or the date of the activity concerned. For a membership fee or payment request, the payout is made within 30 days of payment.

The Organizer remains solely responsible for the provision of the service paid for by the Participant. The sales contract for the service is concluded directly between the Participant and the Organizer; Benevoo is not a party to this contract.

Benevoo does not guarantee the performance of the service by the Organizer. In case of dispute regarding the performance of the service, the Participant must contact the Organizer directly.

Refunds and cancellations

Any request for refund, cancellation or postponement relating to an activity, a membership fee or a payment request must be addressed directly to the relevant Organizer. The Organizer freely defines their own refund policy and is solely empowered to decide whether or not to grant a refund.

Important

Benevoo acts only as a technical payment intermediary and does not handle refunds. Once funds are transferred to the Organizer, any refund request falls exclusively within the relationship between the Participant and the Organizer.

In the event of cancellation of an event or activity by the Organizer before the funds have been paid out, Benevoo may, at the Organizer's request and under their sole responsibility, refund the Participants concerned. Refund-related fees remain at the Organizer's expense.

The service commission charged by Benevoo on a transaction remains acquired in the event of a subsequent refund by the Organizer. Only the net amount paid out to the Organizer is concerned by the refund.

The Organizer agrees to process any refund request within a maximum period of 14 working days from its receipt.

Unpaid amounts, fraud and chargebacks

Any unpaid amount, chargeback or proven fraud on a transaction is charged to the Organizer. The latter reimburses Benevoo for the amounts concerned as well as any associated bank fees.

Liability

Benevoo strives to provide a reliable, continuous and secure service, but cannot guarantee the total absence of interruptions, errors or technical malfunctions. The User acknowledges that use of the platform is at their own risk.

Benevoo's liability cannot be engaged for any indirect or immaterial damage (loss of opportunity, loss of business, damage to image, etc.) resulting from the use or inability to use the platform.

Benevoo is not responsible for the content published by Organizers (event descriptions, activity conditions, prices, dates, locations, etc.) nor for the actual execution of the services offered. The Organizer is solely responsible for the truthfulness and accuracy of the information published.

Benevoo's total liability towards a User, all damages combined, shall in no case exceed the amount of commissions actually received by Benevoo for the transactions concerned over the last 12 months.

Personal data protection

The processing of Users' personal data is subject to a dedicated policy, compliant with the Swiss Federal Data Protection Act (FADP) and the General Data Protection Regulation (GDPR). To learn more, please consult our privacy policy.

By using the platform, the User acknowledges having taken note of this policy and accepts the processing of their data under the conditions described therein.

Changes to the terms

Benevoo reserves the right to modify these Terms at any time. The applicable version is the one published on the website at the time of use of the platform. The date of the last update is indicated at the top of this page.

In the event of substantial changes, Users with an account will be informed by email. Continued use of the platform after modification constitutes acceptance of the new Terms.

Applicable law and jurisdiction

These Terms are governed exclusively by Swiss law, to the exclusion of conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Lake District, Canton of Fribourg, Switzerland.
